End-User License Agreement (EULA)

Effective Date: April 2, 2026

This End-User License Agreement ("EULA") is a legal agreement between you ("User") and rafcolm_ Software, operated by Rafael J. Colón, Caguas, Puerto Rico, USA ("Licensor") for the use of the The Santa AI mobile application ("the App").

By installing or using the App, you agree to be bound by the terms of this EULA. If you do not agree, do not install or use the App.

1. License Grant

Subject to your compliance with this EULA, the Licensor grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on a device that you own or control, solely for your personal, non-commercial purposes.

2. License Restrictions

You may not:

  • Copy, modify, or distribute the App or any portion of it
  • Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the App
  • Rent, lease, lend, sell, sublicense, or otherwise transfer the App to any third party
  • Remove, alter, or obscure any proprietary notices, labels, or marks on the App
  • Use the App to develop a competing product or service
  • Use the App in any manner that violates applicable laws or regulations

3. Ownership

The App, including all intellectual property rights therein (code, design, AI models, trademarks, and content), is and remains the sole property of the Licensor. This EULA does not grant you any ownership interest in the App.

4. Third-Party Terms

The App is distributed through the Apple App Store and Google Play Store. Your use of the App is also subject to the terms and conditions of the applicable store:

In the event of a conflict between this EULA and the applicable store terms, the store terms shall prevail to the extent of the conflict.

5. Subscriptions

The App offers in-app subscriptions (Free and Premium tiers). Subscription billing, renewal, and cancellation are managed entirely through the Apple App Store or Google Play Store. See our Terms of Service for details.

6. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

The Licensor does not warrant that the App will be uninterrupted, error-free, or free of harmful components. AI-generated content may not always be accurate or appropriate.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE LICENSOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE APP.

The Licensor's total aggregate liability shall not exceed the amount you paid for the App in the 12 months preceding the event giving rise to the claim.

8. Children's Use

The App is designed for use by children under the supervision of a parent or legal guardian. The parent or guardian is responsible for the child's use of the App and must provide consent during the onboarding process. See our Privacy Policy for details on how we handle children's data.

9. Termination

This EULA is effective until terminated. Your rights under this EULA will terminate automatically if you fail to comply with any of its terms. Upon termination, you must cease all use of the App and delete all copies from your devices.

The Licensor may also terminate this EULA at any time by disabling your access to the App. This includes banning your account from the App — temporarily (for a set period) or permanently — where the Licensor reasonably believes you have violated this EULA or the Terms of Service. Where a ban is temporary, access is automatically restored when the ban period ends.

10. Governing Law

This EULA shall be governed by and construed in accordance with the laws of the Commonwealth of Puerto Rico and applicable federal laws of the United States, without regard to conflict of law principles.
